NO PURCHASE OR MEMBERSHIP NECESSARY TO ENTER OR WIN. A PURCHASE OR MEMBERSHIP WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
The Pheasant Nation 2024 GMC HUMMER EV Giveaway (the "Giveaway") is a sweepstakes. These Official Rules (the "Rules") form a binding agreement between you and the Sponsor. By entering, you agree to these Rules and to the decisions of the Sponsor, which are final on all matters relating to the Giveaway.
1. Sponsor
The Giveaway is sponsored by Pheasant Nation LLC, 2028 23 RD, Kearney, NE 68845 ("Sponsor"). Questions: support@pheasantnation.com or 308-223-3411. This Giveaway is not sponsored, endorsed or administered by, or associated with, General Motors, GMC, Meta (Facebook/Instagram), TikTok, Shopify or any other third party. GMC and HUMMER are trademarks of their respective owners and are used only to describe the prize.
2. Eligibility
The Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia, EXCLUDING residents of New York and Florida, who are at least eighteen (18) years old at the time of entry, or nineteen (19) for residents of Alabama and Nebraska and twenty-one (21) for residents of Mississippi. The prize winner must hold a valid driver's license at the time the prize is awarded.
Officers, directors, members, managers and employees of Sponsor, its parent, affiliates, prize providers and advertising or promotion agencies, and the immediate family members (spouse, parents, siblings, children and each of their spouses) and household members of each, are not eligible. Void in New York, Florida, Puerto Rico, all U.S. territories and possessions, outside the United States and where prohibited or restricted by law. Subject to all applicable federal, state and local laws and regulations.
3. Promotion Period
The Giveaway begins at 5:00:00 p.m. Central Time ("CT") on October 14, 2026 and ends at 11:59:59 p.m. CT on the EARLIER of: (a) the Milestone Date, or (b) October 16, 2027 (the "Promotion Period"). The last day of the Promotion Period is the "Entry Close Date."
"Milestone Date" means the date on which Sponsor first verifies that Pheasant Nation has ten thousand (10,000) Active Members. "Active Member" means a person with a paid Pheasant Nation membership that is current and in good standing, and has not been cancelled, refunded or reversed. Sponsor will announce the Milestone Date and the resulting end of the Promotion Period on pheasantnation.com within one (1) business day of the Milestone Date.
THE PRIZE WILL BE AWARDED WHETHER OR NOT THE 10,000 ACTIVE MEMBER MILESTONE IS REACHED. If the milestone is not reached, the Giveaway ends on October 16, 2027 and the drawing is held as described in Section 5. Sponsor's computer is the official time-keeping device for the Giveaway.
4. How to Enter
There are two ways to earn entries. Both methods are treated equally: each eligible entry has the same chance of winning, whether it was earned with a purchase or through the free mail-in method. There is no online free entry form.
A. Purchase Entries. During the Promotion Period, every completed order at the Pheasant Nation online store (pheasantnation.com and pheasantnation.myshopify.com), including membership purchases, automatic membership renewals, merchandise and contributions to the Conservation & Banded Bird Fund, earns one (1) entry for every $1.00 of product price paid, after discounts and rounded to the nearest whole dollar. Sales tax, shipping and gift card purchases do not earn entries. For example, a 3-Month Membership ($29.99) earns 30 entries, a 6-Month Membership ($54.99) earns 55 entries and a 1-Year Membership ($99.99) earns 100 entries. Entries are credited to the person named on the order, using the email address on the order, after payment is completed. Orders placed before the Promotion Period begins do not earn entries. Contributions to the Conservation & Banded Bird Fund are paid to Sponsor, a for-profit company; they are not charitable donations, are not tax-deductible, and earn entries on the same terms as any other order. Contributions mailed with the Pheasant Nation Contribution Form earn one (1) entry per $1.00 contributed, credited after payment clears, if the contributor checks the entry box and meets the eligibility requirements. The Contribution Form is a payment form; it is not required to enter, and the free method in Section 4.B is always available. If an order is cancelled, refunded or charged back, its entries are reduced by the refunded amount or voided.
In-person cash contributions. At Pheasant Nation events and locations, a person may make a cash contribution to the Conservation & Banded Bird Fund using a Pheasant Nation Cash Contribution Voucher. Each voucher has a pre-printed serial number and two parts: an office copy kept by Sponsor and a customer receipt kept by the contributor. A cash contribution earns one (1) entry for every $1.00 contributed, rounded to the nearest whole dollar, if all of the following are met: (i) the contributor completes the voucher, including name, mailing address with state, email, phone and date of birth, and the eligibility certifications; (ii) a Pheasant Nation staff member records the amount received, prints and signs their name, and dates the voucher; and (iii) Sponsor receives and logs the office copy. Staff submit a photo of the office copy to Sponsor the same day. Entries are credited when Sponsor logs the voucher, and only for contributions received during the Promotion Period. The customer receipt is proof of payment and is valid only if it bears a Pheasant Nation staff signature and a serial number that matches Sponsor's records. Vouchers that are altered, copied, unsigned or not logged, or whose serial number does not match Sponsor's records, are void. Sponsor's voucher log controls in any dispute about the amount contributed or the number of entries. Cash contributions are paid to Sponsor, a for-profit company; they are not tax-deductible and are non-refundable except where required by law. The voucher is a payment receipt; it is not required to enter, and the free method in Section 4.B is always available.
B. Free Mail-In Entry (no purchase or membership necessary). Print the Official Mail-In Entry Form at pheasantnation.com/free-entry. Complete every field by hand in ink (first and last name, street address, city, state, ZIP, email, phone, date of birth, the eligibility certifications, signature and date), check the box for the 2024 GMC HUMMER EV Giveaway, and mail the form in its own stamped envelope to: Pheasant Nation Hummer EV Giveaway, Free Entry, 2028 23 RD, Kearney, NE 68845. Each complete, eligible form earns fifty (50) entries. There is no limit on the number of forms a person may mail, other than one (1) form per envelope and the overall entry limit in Section 4.C, so any entrant can reach the same maximum number of entries without a purchase. Mail-in entries must be postmarked during the Promotion Period and received within seven (7) days after the Entry Close Date.
No printer? Mail a self-addressed, stamped envelope marked "Form Request" to the address above, and Sponsor will mail you blank Official Mail-In Entry Forms. You may also hand-copy the form's fields onto a plain sheet of paper; a hand-copied form with every field completed is accepted the same as a printed form.
The following mail-in entries are void: more than one form in an envelope; forms completed or submitted by anyone other than the entrant; forms that are pre-filled, typed, or mechanically or digitally reproduced; and forms that are incomplete, illegible, unsigned or postage-due. Forms are not acknowledged or returned and become the property of Sponsor.
C. Entry limit. Each person may earn a maximum of one hundred thousand (100,000) entries in total during the Promotion Period, from all methods combined. Entries above this limit are disregarded. A person may use only one email address. Entries obtained using multiple names, identities, email addresses or accounts, or any automated, scripted or bulk method, are void and may result in disqualification.
If there is a dispute about who earned an entry, the entry belongs to the natural person named on the order, the mail-in form or the Cash Contribution Voucher. Sponsor may require proof of identity, residency and age. Proof of mailing is not proof of receipt.
5. Winner Selection and Odds
One (1) potential winner will be selected in a random drawing from all eligible entries received during the Promotion Period, conducted by Sponsor or an independent party chosen by Sponsor, on or about ten (10) days after the Entry Close Date, so that mail-in entries postmarked by that date can arrive. The odds of winning depend on the total number of eligible entries received.
6. Prize
One (1) Grand Prize: a used 2024 GMC HUMMER EV SUV 3X (4-door, 4WD, Triple AC Electric Motors), VIN 1GKB0RDC3RU101528, with fewer than 1,000 miles on the odometer at the start of the Promotion Period. Approximate Retail Value ("ARV"): $78,300. The ARV is based on the Sponsor's good-faith estimate of the vehicle's fair market value at the start of the Promotion Period; the actual value may vary. Total ARV of all prizes: $78,300.
The vehicle is awarded "AS IS" and "WITH ALL FAULTS," with no warranty or guarantee of any kind from Sponsor, except any remaining manufacturer's warranty, which transfers subject to its own terms. Make, model, color, options and condition are as Sponsor has them at the time of award. The winner is responsible for all federal, state and local taxes on the full ARV, and for title, registration, license and documentation fees, insurance, and all other costs not expressly stated here. The winner must present a valid driver's license and proof of insurance before taking possession. Sponsor will deliver the vehicle, at no cost to the winner, to the winner's address in the contiguous forty-eight (48) United States or the District of Columbia. A winner who lives in Alaska or Hawaii will take delivery at a location in Nebraska chosen by Sponsor. The delivery date is to be determined: Sponsor will schedule delivery with the winner after the winner has been verified and publicly announced. If the winner does not accept delivery within thirty (30) days after the delivery date Sponsor offers, the prize may be forfeited.
The prize is not transferable, and no substitution or cash equivalent is allowed except by Sponsor, which may substitute a prize of equal or greater value, or pay the ARV in cash, if the advertised prize becomes unavailable for any reason. Sponsor will issue IRS Form 1099-MISC to the winner for the full ARV, and the winner must provide a completed IRS Form W-9 before the prize is awarded.
7. Winner Notification and Verification
Sponsor will attempt to contact the potential winner by email and phone, using the information provided with the entry, within five (5) business days after the drawing. The potential winner must respond within seven (7) days and must sign, have notarized and return an Affidavit of Eligibility, Liability Release and Publicity Release (where lawful), and a Form W-9, within fourteen (14) days after they are sent. If a potential winner cannot be reached, does not respond or return the documents in time, is found ineligible, declines the prize, or the prize notification is returned as undeliverable, the prize is forfeited and an alternate winner may be selected from the remaining eligible entries, up to three (3) alternates. A person is not a winner until verified and confirmed by Sponsor.
8. Publicity
Except where prohibited by law, by accepting the prize the winner grants Sponsor the right to use their name, city, state, photograph, likeness, voice and statements about the Giveaway for advertising and promotion in any media, without further notice or compensation.
9. General Conditions
Sponsor may disqualify anyone who tampers with the entry process or the operation of the Giveaway, acts in violation of these Rules, or acts in a disruptive or fraudulent manner. If the Giveaway cannot run as planned because of fraud, technical failure, a natural disaster, government action or any other cause beyond Sponsor's reasonable control that corrupts or affects its administration, security, fairness or integrity, Sponsor may cancel, modify or suspend the Giveaway, and in that event will award the prize in a random drawing from the eligible entries received before the event that caused the action. Any change to these Rules will be posted at pheasantnation.com/official-rules. Sponsor is not responsible for lost, late, incomplete, misdirected or illegible entries or mail, or for any computer, network, website or telephone failure.
10. Release and Limitation of Liability
By entering, you agree to release, discharge and hold harmless Sponsor, its parent, affiliates, prize providers and agencies, and each of their officers, directors, members, managers, employees and agents (the "Released Parties"), from any and all claims, losses, damages and injuries of any kind (including personal injury, death and property damage) arising out of or relating to your participation in the Giveaway or the acceptance, possession, use or misuse of any prize, including any travel to take delivery of the prize. The Released Parties are not responsible for incorrect or inaccurate entry information or for any human, technical or other error in the processing of entries or the administration of the Giveaway.
11. Disputes
These Rules are governed by the laws of the State of Nebraska, without regard to conflict-of-law rules. Except where prohibited, any dispute arising out of or relating to the Giveaway will be resolved individually, without resort to any class action, exclusively in the state or federal courts located in Buffalo County, Nebraska. Except where prohibited, any recovery is limited to actual out-of-pocket costs of entering (if any), and you waive any right to attorneys' fees and to punitive, incidental or consequential damages.
12. Privacy
Information collected from entrants is used to administer the Giveaway and award the prize, and as described in Sponsor's Privacy Policy at pheasantnation.com/privacy. Entering through the free method does not sign you up for a membership or for marketing emails unless you choose to opt in.
13. New York and Florida
The Giveaway is not open to residents of New York or Florida. Sponsor may later open the Giveaway to residents of those states, after completing any registration and bonding required by their laws, by posting an amendment to these Rules at pheasantnation.com/official-rules. Entries from those states received before such an amendment is posted are void.
14. Winner's Name
To obtain the winner's name, available after the winner is confirmed, visit pheasantnation.com/giveaways or send a self-addressed stamped envelope, received within sixty (60) days after the drawing, to: Pheasant Nation Giveaway Winner, Pheasant Nation LLC, 2028 23 RD, Kearney, NE 68845.
