Membership Terms of Service

Effective date: October 14, 2026

PLEASE READ THESE TERMS CAREFULLY. YOUR MEMBERSHIP RENEWS AUTOMATICALLY UNTIL YOU CANCEL (SECTION 4). THESE TERMS LIMIT OUR LIABILITY (SECTIONS 14–15) AND REQUIRE DISPUTES TO BE RESOLVED INDIVIDUALLY IN NEBRASKA (SECTION 17).

1. About these Terms

These Membership Terms of Service (the "Terms") are an agreement between you and Pheasant Nation LLC, 2028 23 RD, Kearney, NE 68845 ("Pheasant Nation," "we," "us"). They apply to your Pheasant Nation membership, the Pheasant Nation app at app.pheasantnation.com, the website at pheasantnation.com, and the events, programs and features we offer (together, the "Services"). By buying a membership or using the Services, you agree to these Terms, our Privacy Policy, and, before using member features, the PN Liability Waiver.

2. Eligibility and your account

• You must be at least 18 years old (19 in Alabama and Nebraska, 21 in Mississippi) to buy a membership. A parent or legal guardian may let a minor use the Services with them, under their supervision and responsibility.
• Memberships are purchased through our Shopify store. You sign in to the app with the email address used at checkout. Keep your email account secure; you are responsible for activity under your membership.
• Each membership is for one person. You may not share, sell or transfer your membership or sign-in.

3. Membership plans and what's included

We currently offer these plans (prices in U.S. dollars, plus any applicable tax):

• 3 Months, $29.99: member app access and the member discount on Pheasant Nation merchandise for the 3-month term.
• 6 Months, $54.99: the above for the 6-month term, plus one free gift with a retail value of up to $20.
• 1 Year, $99.99: the above for the 1-year term, plus one free gift with a retail value of up to $50.

Member app access includes features such as the members-only release map and release updates, The Upland Report, the Hunt Planner, member giveaway entries (see Section 10), recipe submissions, and banquet registration. Features may be added, changed or retired over time. Release locations, dates and other information are provided for general information and may change.

Free gifts. One free gift is provided with each paid 6-month or 1-year term, including renewals. Pheasant Nation chooses the gift, which may vary based on availability. Gifts are shipped to the shipping address on your order within the United States, have no cash value, and cannot be exchanged for cash or credit. We are not responsible for gifts sent to an incorrect address you provided.

Member discount. The member discount applies to eligible Pheasant Nation merchandise in our Shopify store while your membership is active, and is applied at checkout when you are signed in or use your member code. The discount amount may change, cannot be combined with other offers unless stated, and does not apply to memberships, gift cards or shipping.

4. Automatic renewal and cancellation

YOUR MEMBERSHIP RENEWS AUTOMATICALLY AT THE END OF EACH TERM FOR ANOTHER TERM OF THE SAME LENGTH, AND WE WILL CHARGE YOUR PAYMENT METHOD THE THEN-CURRENT PRICE, UNTIL YOU CANCEL.

• How to cancel: cancel any time from your account (app: Account → Manage Membership, or the Shopify customer account), or by emailing support@pheasantnation.com or calling 308-223-3411. Cancel at least 24 hours before your renewal date to avoid the next charge.
• What happens when you cancel: your membership stays active until the end of the term you already paid for, then ends. You will not be charged again.
• Reminders: for every plan, we will email you a reminder 3 to 7 days before each renewal date with the renewal price, the renewal date and how to cancel.
• Price changes: if the price of your plan changes, we will tell you before it applies to your next renewal, and you may cancel before it takes effect.
• Failed payments: if a renewal payment fails, member features may be paused until payment is updated.

5. Refunds

Membership fees are non-refundable once a term begins, except: (a) if you cancel within 7 days after your first-ever membership purchase and before a free gift has shipped, we will refund that purchase in full; and (b) where a refund is required by law. To request a refund, email support@pheasantnation.com or call 308-223-3411. Merchandise returns are handled under the return policy shown in our Shopify store.

6. PN Liability Waiver

Hunting and outdoor activities carry real risks. Before using member features, every member must sign the PN Liability Waiver (release of liability, assumption of risk and indemnity agreement) online at pheasantnation.com/waiver or in the app. That agreement is part of these Terms. If we update it, you may be asked to sign the new version to keep using member features.

7. Hunting, land access and safety

• You are responsible for following all hunting, firearms, wildlife and trespass laws, and for holding any required licenses, permits, stamps and hunter-education certification.
• Release maps, locations, directions and Hunt Planner information are for information only. They are not permission to enter or hunt any property. You are responsible for confirming boundaries and obtaining any landowner permission required by law.
• Hunts members plan with each other. The Hunt Planner, check-ins and invites are tools for members to coordinate on their own. Pheasant Nation does not organize, lead, guide, supervise or insure hunts that members plan, and does not screen, background-check or verify the identity, licenses, experience or conduct of any member, guest or landowner. You choose who you hunt with and are responsible for your own safety and decisions.
• Guests. Guests you invite are your responsibility. You must make sure they follow the law and these safety rules. Guests who are not members may not use member features.
• Pheasant Nation is not responsible for the conduct of any member, guest or landowner, and may remove anyone from the Services for unsafe or unlawful conduct.

8. Merchandise, free gifts and prizes

Merchandise is sold through our Shopify store and is also governed by the store's Terms of Service, Refund Policy and Shipping Policy shown at checkout. Product photos, colors and descriptions are as accurate as we can make them but may vary slightly. If we list a product at the wrong price, we may cancel the order and refund you.

• Use products as intended. Follow all labels, instructions, sizing and care directions. Apparel and accessories, including blaze-orange items, are not safety equipment unless the label says so, and do not replace hunting laws or the safety rules in Section 7.
• Pre-orders. Pre-order ship dates are estimates. If a pre-order will ship later than stated, we will let you know and you may cancel for a full refund before it ships.
• Warranties. Products made by other brands are covered only by their manufacturer's warranty, if any. Except as stated in our store policies and to the fullest extent permitted by law, merchandise, free gifts and prizes are provided "as is," without other warranties. Some states do not allow these exclusions, so they may not apply to you.
• Limit. To the fullest extent permitted by law, our liability for any product, free gift or prize is limited to the price you paid for it (or, for a free gift or prize, its stated retail value). Nothing here limits liability that cannot be limited by law.

9. Recipes and food safety

Recipes in The PN Recipe Book, The Upland Report and our other channels are shared by members and others for general information. Pheasant Nation does not test them and does not guarantee results, nutrition information or safety. You are responsible for safely handling, storing and cooking game. Cook game birds to a safe internal temperature (165°F for poultry, according to USDA guidance), remove shot and bullet fragments and the meat around them, and check every ingredient for food allergies and sensitivities. Pregnant women, children and people with health conditions should take extra care with game meat and should ask a doctor about lead exposure from shot.

10. Giveaways and contests

Member giveaways, the 2024 GMC HUMMER EV Giveaway and contests such as The Longest Tail Feather are governed by their own Official Rules at pheasantnation.com/official-rules, which control if they conflict with these Terms. No purchase or membership is necessary to enter or win any giveaway; a free mail-in method of entry is available at pheasantnation.com/free-entry. Purchases, renewals and contributions to the Conservation & Banded Bird Fund may earn giveaway entries as described in the Official Rules. Contributions to the Conservation & Banded Bird Fund are paid to Pheasant Nation LLC, a for-profit company; they are not charitable donations, are not tax-deductible, and are non-refundable except where a refund is required by law.

11. Your content

When you submit stories, photos, recipes, contest entries, comments or other content ("Your Content"), you confirm you own it or have permission to share it, and that it doesn't violate anyone's rights or the law. You keep ownership of Your Content, and you grant Pheasant Nation a non-exclusive, royalty-free, worldwide license to use, edit, display, publish and distribute it (including in The Upland Report, The PN Recipe Book, printed editions that may be given away or sold, social media and promotions), with credit by first name and last initial where practical, and without payment to you. We may edit content for length, clarity and format, and we may decline or remove any content.

The PN Recipe Book and The Season's Dozen. Active members may submit recipes. By submitting, you confirm the recipe is your own (or a family recipe you have permission to share), is not copied from a cookbook, website or other publication, and that you took the photos or have permission to use them. Each season, the twelve (12) recipes with the most likes as of the season's cutoff date (February 15, 2027 for the 2026–27 edition) are selected for the printed edition, The Season's Dozen; we may skip recipes that break these Terms, duplicate another recipe or can't be printed well, and choose the next most-liked recipe instead. Each featured cook receives one free printed copy. Featured cooks are not otherwise paid, and selection is not a prize or giveaway. You may ask us to remove your recipe from the app at any time, but a recipe already included in a printed edition that has gone to press cannot be recalled.

12. Community rules

Don't use the Services to post anything unlawful, unsafe, harassing, hateful, sexually explicit or misleading; to promote illegal hunting or trespass; to share someone's private land location without permission; to spam; or to interfere with or misuse the Services. We may suspend or end the membership of anyone who breaks these rules, acts unsafely, or harms other members, without a refund for the remaining term.

13. Our content and trademarks

The Services, including our name, logos, artwork, maps, text and design, are owned by Pheasant Nation or its licensors. You may use them only for personal, non-commercial use as a member. Third-party names and marks (such as GMC, HUMMER, Shopify, TikTok, Instagram, Facebook and Google) belong to their owners and do not imply endorsement.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE BIRD NUMBERS, HUNTING SUCCESS, THE ACCURACY OF MAPS OR RELEASE INFORMATION, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

15. Limitation of liability and indemnity

TO THE FULLEST EXTENT PERMITTED BY LAW, PHEASANT NATION AND ITS MEMBERS, MANAGERS, EMPLOYEES, VOLUNTEERS AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR YOUR MEMBERSHIP IN THE 12 MONTHS BEFORE THE CLAIM.

Nothing in these Terms limits liability that cannot be limited by law. You agree to indemnify and hold Pheasant Nation harmless from claims arising out of your conduct, Your Content, or your breach of these Terms or the law, as further described in the PN Liability Waiver.

16. Changes and termination

We may update these Terms from time to time. We will post the new version with a new effective date and, for material changes, notify members by email or in the app before they take effect. Continuing to use the Services after that means you accept the changes; if you don't agree, you may cancel. We may suspend or end the Services or your membership for violations of these Terms; if we end the Services for reasons other than your violation, we will refund the unused portion of your current term.

17. Governing law and disputes

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law rules. Before filing a claim, please contact us at support@pheasantnation.com or 308-223-3411 so we can try to resolve it informally within 30 days. Except where prohibited, any dispute will be resolved individually, not as part of a class or representative action, exclusively in the state or federal courts located in Buffalo County, Nebraska, and each party waives any right to a jury trial to the extent permitted by law. Either party may bring an individual claim in small claims court where eligible.
